Energy On The Offensive #031 - Outrageous Marketing Efforts By Plaintiff Attorney's
With millions of dollars on the line, plaintiff attorney's take extreme measures to get and win cases.
Background:
The safety manager of a fleet I work with received this in the mail. Unfortunately, her uncle died in a tragic roadway accident involving a commercial motor vehicle. The plaintiff's attorney based in Dallas, TX, featured in the picture, sent this book to every family member, including nieces and nephews. When you open the book, the screen automatically starts playing a 17-minute video custom-made for their family. The kit even came with a charger in case the battery runs low and you need to charge it…
Takeaways:
We must put the same effort and creativity into mitigating accidents and making our company a deterrent to plaintiff attorney tactics.
Share with drivers that when they are not on their A-game or having an off day, plaintiff attorneys like this are never off their game and waiting for them to mess up.
Innovative Solution:
An issue our industry faces is the long delay it takes insurance companies to contact third parties after an accident. With so many insurance companies, it seems they are doing nothing but sitting and waiting to receive the letter from a plaintiff’s attorney.
For example, if we are at fault for a minor accident and the third party’s vehicle isn’t drivable, the third party, possibly unable to get to work, sits at home and has not heard from anyone in three days or more. What’s the likelihood they decide to get an attorney? Waiting a week or more for an accident report to communicate with the third party is not a winning strategy. Once attorneys are involved, the cost of an accident skyrockets.
We are developing an innovative solution to proactively establish communication with third parties, reducing the number of accidents that result in attorney representation.
